Terms and Conditions
This is a translation for your convenience. If there are differences, the German version is the binding one.
Note: These terms have been written as a careful draft but have not yet been reviewed by a lawyer — in particular the rules on the right of withdrawal for digital subscriptions are legally demanding and should be checked by a professional before publication.
1. Scope
These terms apply to the use of the mobile application "Tendra Pets" (hereinafter "App"), offered by Tristan Ulrich, Brucker Straße 24, 8101 Gratkorn, Austria (hereinafter "Provider"), by registered users (hereinafter "Users").
2. Description of services
The App offers features for managing pets (health data, vaccinations, feeding, costs etc.) for private users and — once approved — extended features for animal shelters, including an optional public adoption list. The App can be used without an account; the data then stays on the device. Optionally a free account can be created to sync data across devices. Use as a pet owner is only possible with a paid subscription after a free trial (see section 4); there is no permanently free version. Use is free of charge for approved animal shelters.
3. Conclusion of contract
By creating an account in the App, a usage agreement for the selected features is concluded between the User and the Provider.
4. Subscription, prices, trial
- After a free trial (its length is shown with the respective subscription offer in the App), further use of the features marked as paid in the App is only possible with an active subscription.
- Current prices are shown in the App or in the respective app store offer (Apple App Store / Google Play Store) before purchase.
- Payment is handled exclusively by Apple or Google under their own terms; the Provider itself does not process any payment data.
- Subscriptions renew automatically for the selected period unless cancelled in good time before expiry via the store settings (App Store/Play Store).
- Cancellation is only possible via the account management of the respective app store, not directly with the Provider.
5. Right of withdrawal
Consumers within the EU generally have a 14-day right of withdrawal for distance contracts. For digital services that begin before the end of the withdrawal period with the User's express consent, the right of withdrawal may expire early; the App points this out separately at the relevant place. Otherwise, the withdrawal terms for in-app purchases are primarily governed by the terms of the respective app store.
6. Obligations of the User
- Shelter users are themselves responsible for the accuracy of the animal data they enter and — when using the public adoption list — for the lawfulness and appropriateness of the content published there.
- Login details must be kept confidential.
- The App must not be used for unlawful purposes.
7. Availability
The Provider strives for high availability of the cloud features but does not guarantee uninterrupted access. Purely local use of the App does not depend on the availability of the cloud services.
8. Liability
The Provider is liable without limitation for intent and gross negligence and in accordance with the Product Liability Act. For slight negligence the Provider is only liable for breach of essential contractual obligations, limited in amount to the foreseeable damage typical for the contract. Liability for data loss is excluded insofar as the damage could have been avoided by regular, reasonable own backups (e.g. via the App's export feature). The Provider accepts no liability for content published by shelter users via the public adoption list.
9. Ending the account
The User can delete their account in the App at any time; this removes their data stored in the cloud (see Privacy Policy, section 6). The Provider can block accounts in the event of a serious breach of these terms.
10. Changes to these terms
The Provider may change these terms with effect for the future, for example for new features or legal requirements. Users will be informed about material changes in the App.
11. Applicable law, place of jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the User has their habitual residence remain unaffected. Consumers can also use the EU online dispute resolution platform.
